The court will make a decision as to who is going to pay the credit cards after the divorce. That will be according to the court order. Assets and debts in a divorce are divided equitably under the statute in Ohio. So if you have a lot of credit card debt, if it is credit card debt that was accumulated during the marriage for marital purposes such as food, clothing, shelter, those kinds of things, typically, the court will divide them equitably. If those debts were created because somebody was gambling too heavily or something like that, then the court will typically carve those out and apportion them to the individual that was wasting the asset.
